Welcome to Contact Agency, a unique people first model booking system offering an online streamline booking process. To ensure that this process takes place in a safe and lawful environment, we wish to be transparent on the data we may collect from you, how we may use it and for what reasons. We also wish to empower you to make the best decisions about the information you may share with us, so that Contact is a trustworthy place for both Models and Clients.We make sure to only use necessary information from you in order to run and improve our Service. Please note that in accordance with the General Data Protection Regulation, Contactis a data controller (the company is responsible for and controls the processing of your personal data)

Our Privacy Policy is designed to be accessible, focusing closely on our privacy practices and principles. Note that any capitalised words are intended the same way that they are described in our Terms of Use for Clients (TUC) and/or Terms of Use for Models(TUM).

  • 1. INFORMATION COLLECTED FROM YOU ON CONTACT

    • 1.1 INFORMATION YOU CREATE OR PROVIDE US DIRECTLY

      a. Account Creation

      Your Account creation must be approved by Contact for you to use the Service. Once Contact has approved your Account, the Service functionalities will become available to you, such as finding a Model (for a Client) or being booked by a Client (for a Model).

      You must be at least 18 years of age to have an Account on Contact. In some cases, Contact may allow some Models to be between 18 and 16 years of age, subject to Contact’s sole discretion and under certain strict conditions (such as a parental consent - as described in the Eligibility section of our TUM).

      Please remember that you are responsible for any information and User Content that you make available on Contact. A lot of information and User Content that you enter to create an Account, become public and searchable by other Users. THINK CAREFULLY ABOUT WHAT YOU UPLOAD AND SHARE ON CONTACT, ESPECIALLY IF IT IS SENSITIVE INFORMATION.

      If you remove information that you have uploaded on the platform, copies may remain viewable in cached and archived pages and other Users might have copied or saved that information, which is beyond our control. You are responsible for what you upload and for determining if the level of access to your User Content is appropriate.

      When you register on Contact, we ask for certain information from you

      • a. (i) Model:

        For a Model to create an Account, we will request the Model’s name, email, phone number, addresses and a password. Model will also need to provide their date of birth, location, measurements (such as your height, waist size, chest or bust size, hips size, leg length, shoe size, suit size) and some other physical details such as gender, complexion, eye colour, hair colour and style. All of the information mentioned within this paragraph shall be collectively defined as the “Model’s Description”.

        The whole Model’s Description will be available publicly, expect for the Models’ age, which only become visible for logged-in Users. Clients may be able to search any Model via the Model’s Description indicated on each Model’s Account, depending on the functionalities.

        In addition, Contact will take photographs from Models and upload them on the Model’s Accounts. Such photographs, videos and any other medias including the Models, will be public on the Service. Thus, anyone will be able to see and access all of the Model’s photographs, videos and other medias available on each Model’s Account.

        Lastly, Models can also add additional information, such as their social medias pages, an introductive text, a biography and a quote about them. Such details will be public on Contact and visible to any User or visitor.

        Public Information: PLEASE NOTE THAT AS A MODEL, ONCE YOU HAVE REGISTERED ON CONTACT, YOUR ACCOUNT IS PUBLIC ON THE SERVICE. AS SUCH, A MODEL’S DESCRIPTION, GENDER, MEASUREMENTS, LOCATION, PHOTOS/VIDEOS/MEDIAS AND OTHER INFORMATION PROVIDED AND UPLOADED ON THE SERVICE BY YOU OR CONTACT, ARE ALWAYS PUBLIC AND VISIBLE TO ANY VISITOR AND USER AND ON CONTACT. MODEL’S AGE IS ONLY VISIBLE TO LOGGED-IN USERS.

        Some of the information you choose to provide Contact to use the Service, might be considered "special" or "sensitive" in certain jurisdictions, such as the Model’s Description or your phone number for example. BY CHOOSING TO PROVIDE THE INFORMATIONS MENTIONED HEREIN, YOU HEREBY CONSENT TO CONTACT COLLECTING AND PROCESSING SUCH INFORMATION FROM YOU AS DESCRIBED WITHIN THIS PRIVACY POLICY.

        Please make sure you are old enough to consent to the processing of your personal data in your own country.

        Your email address, address, phone number and password remain private and are only required for administrative purposes.

      • a. (ii) Clients:

        As a Client we will request your name, company name, images/videos, email, phone number, address and a password. You can also add additional information, such as your social medias pages. Your displayed name, company name and social media pages are always public on Contact. Also, once you process a Job Offer or a Job Booking with a Model, such Model will be able to access all of the information you made available on Contact, including your address, phone number and email.

        Your password remains private and are only required for administrative purposes.

        Public information: Some of the information you choose to provide Contact to use the Service, might be considered "special" or "sensitive" in certain jurisdictions, such as your phone number or payment details for example. BY CHOOSING TO PROVIDE THESE INFORMATIONS, YOU HEREBY CONSENT TO CONTACT COLLECTING AND PROCESSING SUCH INFORMATION FROM YOU AS DESCRIBED WITHIN THIS PRIVACY POLICY.

      b. Research Models

      The research functionality allows Clients to find Models on Contact through a search of either name, location, age, gender and/or measurements. As a result, we collect and process information from Models about their location, age and physical details and Model’s Description (such as gender, complexion, eye colour, hair colour and style, height, waist size, chest or bust size, hips size, leg length, shoe size, suit size). We also collect and process the research filters used by each Client to research Models on Contact.

      c. Shortlist Creation

      The “shortlist” functionality allows Clients to shortlist some Models. Model shortlists are private until Clients decide to convert such shortlist into Job(s). Hence, we collect information about all the shortlists created on Contact and their conversion into Job(s).

      d. User Content

      We collect all the Content that you create, upload, make available on Contact and/or receive from other Users when you use the Services. This includes the any photographs, video, comments, Message content and other information, which you upload or make available on the Service.

      In some cases, you may upload some pictures, video, soundtrack on the platform. For that purpose, you may allow us to access your camera or photo album. Some of the information you choose to provide us might be considered "special" or "sensitive" in certain jurisdictions, for example your racial or ethnic origins. By choosing to provide this information, you consent to our processing of that information.

      e. Jobs

      Contact collects and processes information about every Job Offer and every Job booking happening via the Service as well as all the interactions, decisions and other information resulting out of those. Hence, each time you offer a Job (as a Client) and accept/decline a Job Offer (as a Model) and/or finalise a Job booking, you agree for Contact to collect and process all of the information relating to it (from a simple Offer stage to a completed Job booking stage).

      f. Payments

      • h. (i) Models:

        As a Model, Contact may request your bank details and other payment information from you in order to invoice and/or bill you for using the Service as well as to collect and process your payment for any Job booked via the Service.

        Payment information shall remain private and are meant for Contact’s use to provide you with the Service. Thus, as a Model, you hereby consent for Contact to collect and process such payment information from you.

      • i. (ii) Clients:

        As a Client, Contact may request your bank details and other payment information in order to invoice and/or bill you for using the Service (including the Client’s payment of a Fee to Contact and other potential fees) as well as to collect and process Models’ payments for every Job booked via the Service.

        Payment information shall remain private and meant for Contact’s use to provide you with the Service. Thus, as a Client, you hereby consent for Contact to collect and process such payment information from you.

    • 1.2 COMMUNICATIONS

      Messages between a Client and one or a group of Model(s), are only viewable by the sender, recipient(s) and Contact team members

      IIf you correspond on Contact, we will keep the content of your Messages, your email address and your contact information. Sometimes, we monitor or record these interactions for training purposes and to ensure a high quality of service.

      We also collect data about Users with whom you communicate or share User Content, via direct Messages or otherwise (see Section 7 for more details).

      You may be able to block Users from sending you Messages. We will collect information about who, when and maybe the reasons why you blocked them.

    • 1.3 ACCESS AND USE OF THE SERVICES

      We collect information about how you access and use the Services, which may regard terms or Users you search for, how frequently you access the Services, the time you access the Services or how long you use the Services for. In addition, we will collect data about whether you access the Service from multiple devices, the website from which you came from and other actions you may take on the Services.

    • 1.4 DEVICE INFORMATION

      We collect information about your device. This information can include details about the type of electronic device you use to connect to platform (for instance computer, tablet, smartphone) as well as unique device identifying numbers, operating systems, browsers and applications connected to the Service through the device, your Internet service provider or mobile network, your IP address, crash reports, system activity and the date, time, and referrer URL of your request.

  • 2. PURPOSES OF YOUR INFORMATION COLLECTION

    We mainly use your data to monitor, operate and protect Contact Services and business. We also use this data to help us improve and develop our functionalities and product, in order to provide you with the best possible experience.

    • 2.1 PROVIDE OUR SERVICES:

      We use information provided to us by you to make our Service available, such as the Models you previously booked using Contact as a Client or your measurements or booked Jobs as a Model.

    • 2.2 COMMUNICATE WITH YOU:

      To communicate directly with you we may use information such as your email address or device ID by sending you emails or push notifications and to allow you to find Models on the Service. As part of our marketing communications, we may let you know about our last newsletter or improvements to our Service. If you message us, we will collect your information related to your messages and we will keep a record of your request in order to help and solve any issues or questions you might have

    • 2.3 MAINTAIN & IMPROVE OUR SERVICES:

      We also use your information to ensure that Contact Services are working properly. Plus, we may use the information we collect to develop and improve the quality as well as the functionalities of our Service, for instance implementing new features or develop our search functionality.

    • 2.4 MEASURE PERFORMANCE

      We use data for analytics and measurement to understand how Contact Services are used. For example, we analyse data about how many Users are on Contact, what are they mostly using the Services for, what are they responsive to in order to optimize User experience. To do so, we may use a variety of tools, such as Google Analytics.

    • 2.5 PROTECT CONTACT, OUR USERS, AND THE PUBLIC:

      We use your information to help improve the security, safety and reliability of our Service. This includes detecting, preventing, and responding to fraud, abuse, security risks, and technical issues that could harm Contact, our Users, or the public. Lastly, enforcing our TUC and TUM are additional reasons why we might collect your information.

      Legal key purposes for processing your data:

      1. To perform the Contract we are about to enter into or have entered into with you for the provision of the Service;
      2. Where it is necessary for our legitimate interests or those of a third parties and where your interests and fundamental rights do not override those interests. Here the processing is necessary for our legitimate interests, namely to administer and improve the Service;
      3. To comply with a legal or regulatory obligations in the EU.
  • 3. PROCESSING AND SHARING OF YOUR INFORMATION

    • 3.1 YOUR ACCOUNT INFORMATION:

      Your Account information as described in Section 1.a (i) and (ii) will be available publicly. Models can be searched by any Client on Contact by default. Therefore, by using the Service, you consent to have your Account information, Model’s Description, photographs/videos/other medias displayed to other Users.

      By having an Account on Contact, you can be “found” on the Service. When other Users of the Service attempt to search you by your name or Model’s Description, we will identify you as an existing Model of the Service.

      Please, keep in mind that if you remove information or User Content that you have uploaded on the Service, copies or traces of it may remain on the Internet, beyond Contact’s control.

      Consider your own privacy and personal safety when logging in to Contact Services and sharing your information with anyone. Contact never shares your email address with other Users on the Service without your consent.

    • 3.2 SERVICES PROVIDERS

      We may also share your personal information with certain service providers, who we require to help us operate our Service as well as understand how the Service is used

      When we grant such necessary third-parties access to your personal information, we require that they use your personal information in respect of the applicable laws. Most of our service providers are subject to obligations consistent with this Privacy Policy, any other appropriate confidentiality and security measures, and are performing on the condition that they use your personal data only on our behalf and pursuant to our instructions.     • 3.3 LEGAL PURPOSES AND PUBLIC INTEREST:

      We may preserve, use, or disclose your personal data with third-parties as required to:

      1. satisfy any applicable law, regulation, subpoena/court order, legal process or other government request;
      2. enforce our TUM and/or TUC, including the investigation of potential violations thereof;
      3. explain why we have remove information, User Content or Account from our Service;
      4. investigate and defend ourselves against any third-party claims or allegations;
      5. protect against harm to the rights, property of Contact, its Users or the public as required or permitted by law;
      6. preserve the safety and integrity of Contact including to help prevent spam, abuse, or malicious actors on our Service; and
      7. prevent or otherwise address criminal (including fraud or stalking), security or technical issues.
    • 4.4 CORPORATE DECISIONS

      In the event of a transaction, such as a merger and acquisition, reorganisation, sale of company assets or shares, financing or change of control of our company by a third party as well as in the event of bankruptcy or related or similar proceedings, your personal data might be sold or transferred.

    • 4.5 NON-PERSONAL INFORMATION

      Lastly, we share or disclose non-personal data, such as aggregated information, such asthe total number of times people engaged with a research on Contact, the number of people who clicked on a particular photo or booked Jobs, how much booking have been operated in in a particular location.

  • 4.COOKIES AND OTHER TECHNOLOGIES COLLECTING YOUR INFORMATION

    • We use or may use the data collected through cookies, log files, device identifiers and beacon information to:

      1. provide and monitor the effectiveness of our Services;
      2. monitor aggregate metrics such as total number of visitors, traffic, usage, and demographic patterns on our website and our Services;
      3. diagnose or fix technology problems;
      4. enhance the Service;
      5. automatically update the Contact application on your mobile devices.
  • 5. STORAGE OF YOUR INFORMATION

    • 5.1 HOW CONTACT STORES YOUR INFORMATION

      Your information collected through the Service may be stored and processed in the United Kingdom, United States or any other country in which Contact or its affiliates or service providers maintain facilities. If you are located outside the European Economic Area (EEA) or other regions with laws governing data collection and use that may differ from English and European laws, please note that we may transfer information, including personal information, to a country and jurisdiction that does not have the same data protection laws as your jurisdiction.

      Other companies acting as IT sub-processors are required to respect the security of your personal data and to treat them in accordance with the law. We try to minimise transfer of your personal data outside the EEA but some of our external third parties are based outside the EEA, so their processing of your personal data may involve a transfer of data outside the EEA. In these circumstances, we would only permit your personal data to be transferred outside the EEA, to countries that have been deemed to provide an adequate level of protection for personal data by the European Commission or in the case of US providers based in the US, we may transfer data to them if they are part of the Privacy Shield, which requires them to provide similar protection to personal data shared between the Europe and the US.

      Theoretically, we mightseek to acquire other businesses or merge with them. If a change happens to our business, then the new owners may use your personal data in the same way as set out in this privacy notice.

    • 5.2 HOW LONG CONTACT STORE YOUR INFORMATION FOR

      Following termination or deactivation of your User account, Contact will do its best to delete your data immedialtely from the platform. However, Contact may retain your profile information and User Content information for a reasonable time for backup, analytical archival, or audit purposes. Contact may store personal data for as long as necessary to fulfil the purposes for which we collect the data.

      Please note that the User content you delete may persist for a limited period of time in backup copies and may still be visible where others have shared it. Ultimately if you delete your Account or Content, it will be permanently unrecoverable

  • 6. PROTECTION OF YOUR INFORMATION ON CONTACT

    • Contact cares about the safety and integrity of the information you give us. That is why we put in place reasonable safeguards to preserve all information collected through the Service.

      To protect your privacy and security, we take reasonable steps verify your identity before granting you access to your Account. For instance, we request a unique and strong password including a minimum of 8 characters. You are responsible for maintaining the secrecy of your password and Account information, and for controlling access to your email communications from Contact, at all times. Contact may review any Account creation and shall be entitled to grant or deny it for any reason whatsoever.

      However, Contact cannot warrant the security of any information you transmit to Contact or other Users. Similarly, Contact does not guarantee that information on the Service may not be accessed, disclosed, altered, or destroyed. In the event that any information under our control is compromised as a result of a breach of security, Contact will take reasonable steps to investigate the situation and where appropriate, notify those individuals whose information may have been compromised and take other steps, in accordance with any applicable laws and regulations.

      Data is stored on secure servers, in secure data centers. All data sent to Contact servers is secured by SSL technology.

      Your privacy settings may also be affected by changes of functionality and features as the Service grows and develops. We would then inform you and amend our Privacy Policy accordingly

  • 7. CONTROL OF YOUR COMMUNICATIONS

    • Contact may communicate with you in different ways.

      7.1 COMMUNICATIONS WITH CONTACT

      a. Service Communications:

      We may need to provide you with certain communications, such as some Service announcements and administrative messages. These are made to inform you on the activity of your Account and the Service. It may for instance relate to a forgotten password, a change of Service features or a data breach. These communications are considered being part of your Account and Contact Service. As such, you may not be able to opt-out from receiving them, except if you delete your Account.

      Therefore, by providing Contact your email address, you consent to Contact using your email address to send you service-related notices, in lieu of communication by postal mail and including any notices required by law. If you don’t agree to such communications sent to you, you can disable your Account at any time, as you may not opt out of Service-related emails

      b. Notification Communications:

      We will send notification emails based on the activity of your Account, for example when another Client send you a Job Offer or a message - for a Model, or when a Model accept your Job Offer or send you a message - for a Client. You may opt out of these communications from the settings section.

      c. Marketing Communications:

      We may also send you communications to offer you the best service and keep you updated. As such, we may use your email address to send you other messages, such as newsletters, promotions or special offers. If you do not want to receive such email messages, you may opt out by following the “unsubscribe” link in the email messages and from your account settings. Opting out may prevent you from receiving email messages regarding updates, improvements or offers. Please note that we are not selling or sharing your email address with a third party for marketing purposes.

    • 7.2 COMMUNICATIONS WITH OTHER USERS ON CONTACT

      You can use direct Messages to have non-public conversations between Users on Contact. Any User can send you direct Messages. We share the content of your direct Messages with the people you have sent them to; we do not use such content within the Messages to serve you ads.

      In your direct Messages, if you include and/or interact on some User Content ordinarily displayed on Contact, such an interaction is public.

      When you use features like direct Messages to communicate, remember that the recipients of your Messages will have their own copy of your communications on Contact, which they may duplicate, store, or re-share.

      When you communicate with others by sending or receiving direct Messages, we will store information about whom you have communicated with and when, as well as the content of those communications to analyse the use you make of the Contact Services and to protect the safety and integrity of our platform. We will also store and process your communications and information related to review of reported issues.

  • 8. MANAGING YOUR PERSONAL INFORMATION ON CONTACT

    We provide you with the following rights in respect of the personal information we hold about you and according to the General Data Protection Regulation (GDPR).

    • 8.1. ACCESS YOUR PERSONAL INFORMATION

      You have the right to obtain access to your personal data. As such, you may view, modify and/or delete the personal information you enter. To request access please email us at help@contact.agency. We will provide the information free of charge and within one month from your request, except in the event that the request is unfounded, excessive or repetitive, in which case we reserve the right to charge a proportionate administration fee or refuse.

    • 8.2. UPDATE OR RECTIFY YOUR PERSONAL INFORMATION

      You may at any time update or correct any information that you think is inaccurate or incomplete about you on Contact. However, we may need to verify the accuracy of the new data you provide to us.

    • 8.3. RIGHT TO PORTABILITY

      The right to portability allows you to move, copy or transfer the personal data you have shared through the Service. If you request it, we will provide to you your personal data in a structured, commonly used, machinereadable format. Note that this right only applies to automated information which you initially provided consent for us to use or where we used the information to perform a contract with you.

    • 8.4. RIGHT TO RESTRICTION

      You can restrict the processing undertaken by us on your personal data in certain circumstances, such as where you contest the accuracy of some of your personal data, for a period enabling us to verify the accuracy of that personal data.

    • 8.5. RIGHT TO OBJECT

      You have a right to object to processing based on legitimate interests and when there is something about your particular situation, which makes you want to object to processing on this ground, as you feel it impacts your fundamental rights and freedoms. You also have the right to object where we are processing your personal data for direct marketing purposes. In some cases, we may demonstrate that we have compelling legitimate grounds to process your information, which override your rights and freedoms.

      a. Unsubscribe from marketing communication:

      You can stop receiving promotional email communications from us by clicking on the “unsubscribe link” provided in such communications. We make every effort to promptly process all unsubscribe requests. However, as noted above, you may not opt out of Service-related communications (for instance account verification, changes/updates to features of the Service, technical and security notices) unless you delete your account on Contact.

      b. Opting out from cookies:

      The only way to completely opt out of the collection of any information through cookies or other tracking technology is to actively manage the settings on your browser or device. Please refer to your device or browser’s technical information for instructions on how to delete and disable cookies, and other tracking and recording tools. Depending on your type of device, it may not be possible to delete or disable tracking mechanisms on it.

      Note that disabling cookies and/or other tracking tools may prevent Contact or its partners from tracking your browser’s activities in relation to the Service. Please note that disabling such technologies may prevent the operation of many of the features available through the Service. Hence, by disabling some cookies or other similar technologies, you might not be able to access the Service properly.     • 8.6. RIGHT TO WITHDRAW CONSENT

      At any time, you may withdraw your consent where you may have given it. However, this will not affect the lawfulness of any processing carried out before you withdraw your consent. If you withdraw your consent and we have no alternative legal reason to process your personal data, this withdrawal will be effective and might affect your ability to use our Service. This withdrawal will not affect the lawfulness of any processing carried out before you withdraw your consent. We will advise you if this is the case at the time you withdraw your consent.

    • 8.7. ERASE YOUR INFORMATION

      You have the right to obtain the erasure of your personal data, without undue delay and in certain circumstances, such as where the personal data is no longer necessary in relation to the purposes for which it was collected or processed. You also have the right to ask us to delete or remove your personal data in some cases: where you have successfully exercised your right to object to processing, where we may have processed your information unlawfully or where we are required to erase your personal data to comply with applicable law. However, that we may not always be able to comply with your request of erasure for specific legal reasons which will be notified to you, if applicable, at the time of your request.

      Please remember that requesting a deletion is total and irreversible, unlike a request to unsubscribe from specific emails, such as marketing. This means that Contact may lose record of you having ever been on our systems, including any previous instruction to opt out of specific email type you may have given us. As a result, if you happen to join again our systems by voluntarily providing us your personal information (like your email), you will appear to us as a new data subject.

  • 9. EXTERNAL LINKS ON CONTACT

    We are not responsible for the practices employed by websites or services linked to or from the Service, including the information or User Content contained therein.

    Please remember that when you use a link to go from the Service to another website, our Privacy Policy does not apply to third-party websites or services. Your browsing and interaction on any third-party website or service, including those that have a link on our website, are subject to that third party’s own rules and policies.

    In addition, you agree that we are not responsible for and we do not have any control over any third-parties that you authorize to access your User Content or information through a hyperlink of your Account and/or User Content. If you are using a third-party website or service and you allow such a third-party access to your User Content or information, you do so at your own risk.

    This Privacy Policy does not apply to information we collect by other means (including offline) or from other sources other than through the Service.

  • 10. CHILDREN PRIVACY

    Contact does not knowingly collect or solicit any information from anyone under the age of 13 or knowingly allow such persons to visit Contact Service or register as Users. The Service and its Content are not directed at children under the age of 13.

    You must also be old enough to consent to the processing of your personal data in your own country. This age may vary between 13 and 16 years old in the European Union. Please make sure your use of the Contact is in line with your national minimum age of consent for data processing. In the UK, this minimum age if 13 years old.

    In the event that we learn that we have collected personal information from a child under age 16, without verification of parental consent, we will delete that information as quickly as possible.   • 11. CHANGES TO OUR PRIVACY POLICY

    Contact may modify or update this Privacy Policy from time to time to reflect the changes in our Services or business as well as in the law. Therefore, you should review this page periodically. When we change the policy in a substantial manner, we will let you know and update the ‘last updated’ date at the top of this page.
